Are there penalties if my child is not in the correct car seat?
Yes, NSW Road Rule 266, states that it is the responsibility of the driver of a vehicle to ensure that each passenger under 16 years of age is complying with the road rules otherwise they can face penalties of a fine of up to $2200 in Court;

  • Children up to the age of 6 months must be secured in a rearward facing restraint.
  • Children aged 6 months but under 4 years must be secured in either a rearward facing restraint or a forward facing restraint with an inbuilt harness.
  • Children aged 4 years but under 7 years must be secured in a forward facing restraint with an inbuilt harness or a booster seat.
  • Children who are too small to be restrained by a correctly adjusted lap sash seat belt are strongly recommended to use a booster seat.

ALL child restraints must meet the Australian/New Zealand Standard AS/NZS 1754.

Do I have to get my car seat professionally installed/fitted?
Short answer is no, however some hospitals in NSW require you to present the certificate to show that your child restraint was professionally fitted in your vehicle before you can leave with your newborn baby. This is not a legal requirement, and only the policy of individual hospitals.

Fines and demerit points apply if a driver fails to ensure all children are appropriately restrained in their vehicle. It is your responsibility to understand the everyday use of your restraints and what is appropriate for your children. By understanding how to use your child restraint you are providing the best protection for your children when you are on the road.

Can I use secondhand car seats?
Yes, however there are important things to consider:

~ Do you know the history of the child restraint and can you ensure that it has not been involved in a motor vehicle collision?

~ How old is the child restraint? The date of manufacture is found on all restraints, either printed on a sticker, or stamped into the plastic.

~ Does the child restraint meet Australian standards AS/NZS 1754 Child Restrains for Use in Motor Vehicles? All restraints meeting this standard will have a certified sticker indicating so.

What age can I rotate my child from rearward facing to forward facing?
Legally you can change your child from a rearward facing child restraint into a forward-facing child restraint at 6 months of age. It is recommended that you keep your child rearward facing until the child’s size indicates they have outgrown the restraint position. This is generally when the child is older than 12 months of age.
What age can my child stop using a car seat or booster seat?
Legally a child 7 years of age can travel in a vehicle without a child restraint or booster seat if they are large enough to be correctly restrained by a lap sash seat belt. However an adult lap sash seat belt is designed for people who are at least 145cm tall.

Please follow these five steps to decide whether your child should stop using the restraint:

  1. Sit with their backs firmly against the seat back.
  2. Bend their knees comfortably over the front of the seat cushion.
  3. Sit with the sash belt across their mid-shoulder.
  4. Sit with the lap belt across the top of their thighs.
  5. Stay in this position for the whole car trip.
